In a deeply emotional and legally complex case, the trial of Lindsay Clancy, a Duxbury, Massachusetts mother accused of killing her three young children, has reached its final days. CBS News legal analyst Caroline Polisi joined 48 Hours correspondent Natalie Morales on the "Case by Case" podcast to discuss the most pivotal moments, including shocking expert testimony, the defense's strategy, and the profound community impact.

The Judge's Ruling and the Request for a Mistrial

The trial saw a shocking moment when one of the prosecution's expert witnesses, forensic psychologist Dr. Kirk Heilbrun, brought up Clancy's Catholic faith while on the stand. Dr. Heilbrun recounted Clancy's statement about strangling each child, saying, "Go to God, baby, go to God." He then testified that Clancy believed she and her children would be together in heaven with God, as she was raised Catholic. Defense attorney Kevin Reddington immediately requested a mistrial, arguing that this line of questioning was an "inappropriate area of inquiry" and that the witness's understanding of Catholic dogma was "irrelevant."

Judge Sullivan denied the motion for a mistrial but instructed the jury to disregard the testimony. Caroline Polisi emphasized the highly inappropriate nature of the questioning, especially since the prosecution had previously inquired about Clancy's religious beliefs with her former mother-in-law. Polisi stated that explicitly prohibiting inquiry about a witness's religious beliefs is a fundamental rule of evidence. She believes this could be a compelling issue on appeal if Clancy is convicted, as it doesn't go to the ultimate issue of the case and could be seen as inflammatory and prejudicial.
